Section 1The Service
HamClubOnline (“HCOL,” “we,” “us,” or “our”) is a free, web-based membership management platform for amateur radio clubs, operated by K6VEC Amateur Radio Group, Inc., a California 501(c)3 nonprofit corporation (EIN: 85-2465633), headquartered in Laguna Hills, California.
The Service provides amateur radio clubs and their members with tools for membership roster management, dues processing, license data synchronization, event calendars and attendance tracking, club elections, skills and certification tracking, asset management, financial reporting, mass email communications, SMS and voice alerting, and related functions as described at hamclubonline.com/features.
The basic Service is provided at no charge to clubs or their members. Clubs may independently choose to charge their own membership dues, which may be collected through the platform’s payment processing features. Any such dues are collected on behalf of the individual club and are not fees charged by K6VEC or HamClubOnline. Voluntary donations to support the operation of K6VEC Amateur Radio Group, Inc. may be made through the platform but are not required to access any feature of the Service.
References to “the Service” in these Terms include both the HamClubOnline application at secure.hamclubonline.com and the HamClubOnline website at hamclubonline.com, unless a specific provision expressly limits its application to one of those properties.
Section 2Acceptance of Terms
By registering for an account, logging in to the Service, or using any feature of HamClubOnline, you agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated into these Terms by reference. These Terms constitute the entire agreement between you and K6VEC Amateur Radio Group, Inc. regarding your use of the Service and supersede any prior agreements, whether oral or written.
We reserve the right to update or modify these Terms at any time. We will update the “Last Updated” date at the top of this page when changes are made. Your continued use of the Service following the posting of any changes constitutes your acceptance of the revised Terms. If you do not wish to accept an updated version of these Terms, you may terminate your account in accordance with Section 14 of these Terms. We encourage you to review these Terms periodically.
We make every effort to keep these Terms accurate and current. However, these Terms may contain errors or omissions. If you have questions about a specific provision or believe information in these Terms is incorrect, please contact us at [email protected].
Section 3Eligibility and Account Registration
3.1Age Requirements
You must be at least 13 years of age to use HamClubOnline. The Service is not directed to children under 13, and we do not knowingly permit registration by anyone under 13. If we discover that an account has been created by or for a user under 13 without verifiable parental consent, we will terminate that account and delete associated personal information. Users between the ages of 13 and 17 represent that they have obtained parental or guardian consent to use the Service. This requirement is a platform policy of HamClubOnline and applies in addition to any obligations under applicable law.
3.2Account Accuracy
You agree to provide accurate, current, and complete information when registering for an account and to keep that information updated. This includes maintaining a valid email address, an accurate amateur radio callsign (where applicable), and current contact information. You are responsible for the security of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at [email protected] if you become aware of any unauthorized use of your account.
3.3One Account Per Person
Each individual may maintain only one HamClubOnline account. Creating multiple accounts to circumvent suspension, termination, or any platform rule is prohibited and will result in termination of all associated accounts.
3.4Email Address Requirements
Each HamClubOnline account must be associated with a unique email address. A single email address may not be used to register more than one account. If multiple members within the same household require separate accounts — for example, spouses or family members who are each club members in their own right — each person must use a distinct email address.
Members whose email provider supports subaddressing as defined by RFC 5233 may use subaddressed variants of a single mailbox to satisfy the unique email requirement for additional household accounts. For example, if your email provider supports subaddressing, an address such as [email protected] may be used as a distinct address for registration purposes. Not all email providers support subaddressing; members should verify that their provider supports this feature before relying on it.
Club administrators may update the email address associated with a member’s record until that member has signed in to HamClubOnline and established a password. Once a member has activated their account, the email address is controlled solely by the member and cannot be modified by a club administrator. After account activation, email address changes must be made by the member through their account profile or by contacting HamClubOnline support at [email protected].
3.5Accounts Must Represent Individuals
HamClubOnline accounts are intended for individual persons only. Generic, shared, organizational, or role-based accounts are not supported and are not permitted. Each account must represent a single identifiable individual.
Registration using an amateur radio club callsign, a club’s trustee callsign, or any other callsign that represents an organization, club, or non-individual entity rather than a licensed individual operator is not authorized. HamClubOnline actively blocks registration attempts using recognized club and organizational callsigns. Accounts found to be registered using club callsigns or to represent organizations rather than individuals will be terminated without prior notice.
3.6Password Security and Account Compromise
Many club members will never need to create a HamClubOnline account or establish a password. Core club functions such as membership renewals, dues processing, newsletter delivery, and event notifications can be administered entirely by a club administrator on behalf of members, without any requirement for individual members to register or log in to the platform. Members who do not have an account are not required to create one simply to remain active members of their club on HamClubOnline.
Members who do choose to activate an account — for example, to manage their own profile, pay dues directly, view club rosters, or participate in club elections — are solely responsible for maintaining the confidentiality and security of their HamClubOnline password. Passwords must be between 12 and 50 characters long and contain at least one lowercase letter, one uppercase letter, and one number. We recommend using a password manager to generate and store a strong, unique password. You must not share your password with any other person. HamClubOnline will never ask you for your password by email, phone, or through any support channel. If you receive a request for your password purporting to be from HamClubOnline, treat it as unauthorized and report it to [email protected] immediately.
While HamClubOnline implements built-in technical safeguards against unauthorized access — including password hashing, session management, and infrastructure-level security controls — these measures are not a substitute for your own responsibility to protect your credentials. The security of your account password is your sole responsibility. HamClubOnline bears no liability for any unauthorized access, data loss, or harm resulting from your failure to adequately protect your account credentials, including but not limited to sharing your password, using a weak or reused password, or failing to notify us promptly upon becoming aware of unauthorized access.
If you believe your account or your club’s data has been compromised, contact us immediately at [email protected]. In the event of a confirmed account compromise, HamClubOnline will make reasonable efforts to restore your club’s data and configuration to its prior state to the extent possible given the nature of the compromise and the data available to us. However, we cannot guarantee full restoration of all data, settings, or records in every circumstance, and we make no warranty that prior state can be recovered in all cases. We recommend that club administrators perform regular data exports as described in the Service Discontinuation subsection of Section 12 to protect against data loss from any cause, including account compromise.
Section 4Privacy and Personal Information
The collection, use, storage, and sharing of personal information through the Service is governed exclusively by our Privacy Policy. Please review the Privacy Policy carefully to understand our practices.
HamClubOnline does not store credit card numbers, debit card numbers, or bank account information. All payment transactions are processed directly by PayPal or Square under their respective terms of service and privacy policies. We store only transaction reference numbers returned by those processors after a completed transaction.
Section 5Club Administrators — Responsibilities and Data Stewardship
5.1Role of Club Administrators
As used in these Terms, “club administrator” refers broadly to any club member who has been granted the ability to perform a specific function within HamClubOnline and is authorized to do so on behalf of the club. This includes the holder of the full Club Administrator security role as well as any member who has been assigned a more limited security role — such as Membership Manager, Finance Manager, or Communications Manager — when acting within the scope of that role. The obligations and responsibilities described in these Terms apply to all such members in proportion to their assigned access and function.
A club administrator in the narrower technical sense is a club member who has been assigned the Club Administrator role within HamClubOnline. A club may have one or more club administrators. When a club is first established with HamClubOnline, the person who created the club account is automatically assigned as the initial club administrator. The club is responsible for maintaining at least one active and appropriately assigned club administrator at all times. If a club administrator is no longer available or appropriate for the role, the club is responsible for reassigning the role to another current club member. HamClubOnline bears no responsibility for actions taken or not taken as a result of a club failing to maintain an appropriate club administrator.
In the event that a club loses all of its administrators due to incapacitation, resignation, or other circumstances — or where a current or former club administrator is deliberately withholding or refusing to relinquish administrative access contrary to the wishes of the club’s current leadership — a current club officer or responsible club member should contact HamClubOnline support at [email protected]. HamClubOnline will make reasonable efforts to validate the identity and authority of the requesting party and, where validation is successful, restore appropriate administrative access to the club account or remove administrative access from individuals who are no longer authorized to hold it. HamClubOnline cannot guarantee restoration of access in all circumstances and reserves the right to require reasonable proof of current club officership or authorization before granting or revoking administrative access. The determination of legitimate club leadership for validation purposes is at the sole discretion of HamClubOnline.
Club administrators have significant access to member personal information within their club and bear responsibility for the appropriate stewardship of that data.
Club administrators cannot remove their own administrator role. This restriction is enforced by the platform to prevent a club from being left without an active administrator. An administrator wishing to relinquish their role must have another club administrator remove it on their behalf.
5.2Administrator Obligations
By accepting administrator privileges, club administrators agree to:
- Serve as the primary point of contact and support for their club members’ use of HamClubOnline. Club administrators are responsible for assisting their members with platform-related questions, account issues, and day-to-day use of the Service. HamClubOnline support is intended to support club administrators, not individual club members. Club members seeking assistance should contact their club administrator in the first instance
- Set and maintain their club’s membership dues structure within HamClubOnline, where the club has elected to collect dues through the platform. Dues amounts, tiers, and payment requirements are determined solely by the club administrator and are not established or controlled by HamClubOnline
- Take sole responsibility for all configuration settings applied to their club through the platform, including any automated actions configured to run against club members. HamClubOnline does not review, validate, or approve club configuration settings before they take effect. Misconfigured automated actions may have immediate and significant consequences, including the removal of members from the club roster. HamClubOnline bears no responsibility for consequences arising from misconfigured settings. Club administrators are exempt from automated member removal actions regardless of how those actions are configured
- Ensure that members granted security roles understand their responsibilities, use their access appropriately, and comply with the Terms of Service. The club is responsible for the actions of any member who has been granted a security role. Actions taken within HamClubOnline by a role-holder are considered actions taken on behalf of the club
- Obtain and maintain the authorization of their club prior to and throughout their use of HamClubOnline on the club’s behalf. A club administrator acts as an agent of their club. If a club administrator loses the authorization of their club to use HamClubOnline — whether by resignation, removal from office, or any other circumstance — they must immediately cease acting in the administrator capacity and notify HamClubOnline support at [email protected]
- Use member personal information only for the legitimate purposes of managing their club
- Configure roster display settings in a manner consistent with reasonable member privacy expectations, limiting publicly visible fields to the minimum necessary for legitimate club purposes. Members may opt out of being shown on the club roster, and club administrators must honor such requests promptly
- Not export, share, sell, or otherwise distribute member personal information to third parties outside the club without member consent
- Keep member records reasonably accurate and remove or archive records for individuals who are no longer members or affiliates
- Understand that their ability to update a member’s email address is limited to members who have not yet signed in and established a password. Once a member has activated their account, the email address is controlled solely by the member and can no longer be modified by a club administrator. Any required email address changes for activated accounts must be handled by the member directly or by contacting HamClubOnline support
- Use mass email and SMS and voice alerting features only for their intended, legitimate club purposes and direct all communications only to club members in good standing and designated non-member affiliates as described below
- Not use any HamClubOnline communication feature — including mass email, SMS alerting, voice alerting, event notifications, or newsletter tools — for marketing, advertising, promotional, or commercial purposes of any kind
- Not send communications through HamClubOnline to any person who is not a club member in good standing or designated non-member affiliate of the club
- Not use the platform to solicit membership in their club from the general public. HamClubOnline is intended solely for the management of existing club membership, designated non-member affiliates, and communications with those individuals
- Obtain verifiable parental or guardian consent before entering personal data for any club member or affiliate who is under 13 years of age, in compliance with the Children’s Online Privacy Protection Act (COPPA), 15 U.S.C. § 6501 et seq. Personal data for individuals under 13 must not be entered into the platform without such consent. Where consent cannot be obtained, the individual’s data must not be added to the platform
- Obtain parental or guardian consent before entering personal data for any club member or affiliate who is between 13 and 17 years of age. This requirement is a platform policy of HamClubOnline and applies in addition to any obligations under applicable state law. Club administrators are responsible for maintaining records of such consents and for ensuring that personal data entered for minors is handled in accordance with applicable law
- Ensure that all club activities conducted through or supported by HamClubOnline — including elections, financial transactions, member communications, activations, and use of any platform feature — comply with all applicable local, state, federal, and international laws and regulations governing the club’s operations in its jurisdiction, including but not limited to FCC regulations, nonprofit corporate law where applicable, privacy law, and applicable communications law
- When adding an existing HamClubOnline member to their club by callsign, verify that the email address they provide matches the email address registered with that member’s existing HamClubOnline account. This requirement protects registered member records from unauthorized or incorrect club additions
- Not add test, fictitious, or fabricated records to the platform for any purpose. HamClubOnline is a production platform; due to data retention requirements and data integrity constraints, test or fictitious data cannot be guaranteed to be removed once entered. Club administrators seeking to understand platform features should consult the Club Administrator Guide or contact HamClubOnline support
- Comply with applicable laws governing the collection and use of personal information for the members and affiliates in their club’s jurisdiction
- Promptly notify [email protected] if they become aware of a data breach or unauthorized access to member data within their club
- Ensure that any custom application questions configured for prospective members comply with all applicable laws, including privacy law, anti-discrimination law, and data minimization principles. HamClubOnline does not review or approve club application questions and bears no responsibility for the content of questions asked by clubs or the responses collected. Club administrators are solely responsible for ensuring their application questions are lawful and appropriate
5.3Non-Member Affiliates
Clubs may designate non-member affiliates within HamClubOnline. A non-member affiliate is an individual or organization that a club administrator has specifically added to the club’s roster for the purpose of receiving club communications, but who is not a club member and does not have voting rights in club elections. Non-member affiliates may include, without limitation, affiliated amateur radio clubs, government officials, emergency management coordinators, and other individuals or organizations with a legitimate relationship to the club.
Club administrators are responsible for ensuring that non-member affiliates have consented to receive communications from the club and that the addition of affiliates complies with applicable privacy and communications laws. Non-member affiliates are subject to the same opt-out rights as regular members and may unsubscribe from club communications at any time using the mechanisms described in these Terms and in our Privacy Policy. The addition of non-member affiliates does not expand the permitted use of the platform beyond legitimate club communications purposes.
5.4Club as Data Controller
Each amateur radio club using HamClubOnline is the data controller for its own member data and non-member affiliate data. HamClubOnline operates as the platform and service provider through which clubs manage that data. Clubs are responsible for their own compliance with applicable privacy laws governing the personal information of their members and affiliates.
Section 6Acceptable Use
6.1Permitted Use
The Service is provided for the lawful management of amateur radio club membership and related club activities. You agree to use the Service only for its intended purposes and in compliance with all applicable federal, state, and local laws and regulations, including FCC rules governing amateur radio operation.
6.2Prohibited Conduct
You agree not to use the Service to:
- Transmit spam, unsolicited commercial messages, or mass communications unrelated to legitimate club business through the platform’s email or messaging features
- Use any HamClubOnline communication feature for marketing, advertising, promotional, or commercial purposes, or direct any communication through the platform to a person who is not a club member in good standing or designated non-member affiliate of the sending club
- Add test, fictitious, or fabricated member records to the platform for any purpose, including testing platform features or functionality. HamClubOnline is a production platform serving real clubs and real members. Due to data retention requirements, accounting integrity constraints, and the nature of the platform’s data architecture, test or fictitious data entered into the platform cannot be guaranteed to be removed once added. Club administrators who need assistance understanding platform features should consult the Club Administrator Guide or contact HamClubOnline support at [email protected]
- Use the platform to solicit membership in any club from the general public or from persons who are not club members in good standing or designated non-member affiliates of that club
- Activate SMS or voice alerting features for any purpose other than a permitted activation as described in Section 7
- Harvest, scrape, or systematically collect member personal information from the platform for any purpose other than legitimate club management
- Impersonate any person or entity, or falsely represent your affiliation with any person, entity, or amateur radio club
- Upload, transmit, or distribute any content that is unlawful, defamatory, harassing, abusive, fraudulent, obscene, or otherwise objectionable
- Upload, store, or distribute through the platform any copyrighted work — including photographs, images, documents, music, video, or software — without the express permission of the copyright owner or a license authorizing such use
- Attempt to gain unauthorized access to any other user’s account, any club’s data, or any portion of the platform’s systems or infrastructure
- Introduce viruses, malware, or any other malicious code into the Service
- Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission
- Use the Service in any manner that could damage, disable, overburden, or impair the platform or interfere with other users’ use of the Service
- Violate any applicable law, including but not limited to laws governing privacy, data protection, electronic communications, and amateur radio operation
- Access or attempt to access the Service or any of its data using automated means, including bots, crawlers, scrapers, spiders, AI-driven agents, or any other automated tool or script, without our express prior written permission. Clubs that require programmatic access to club data should use the read-only API described in Section 12, subject to the conditions set out there
- Use any content, data, or information obtained from the Service — including member records, club data, roster information, or any other platform content — to train, fine-tune, evaluate, or otherwise develop any artificial intelligence or machine learning model, system, or product, whether commercial or non-commercial, without our express prior written permission
- Bypass, circumvent, or violate any robot exclusion headers, HTTP response codes, rate limits, IP blocking, or other access control directives implemented on the Service, including but not limited to directives published in the Service’s robots.txt file. Circumventing these controls may constitute a violation of the Computer Fraud and Abuse Act (18 U.S.C. § 1030) and California Penal Code § 502
A breach of any provision of this Section may result in immediate termination of your account and, where appropriate, referral to law enforcement authorities.
6.3Email Communications and Spam Reporting
HamClubOnline periodically validates the email address reputation and deliverability of email addresses associated with member accounts. This validation is performed to protect the sending reputation of the platform and ensure reliable delivery of communications to all clubs and members who depend on it. Email addresses identified as high risk, invalid, or undeliverable — including addresses associated with known spam traps, disposable email services, or addresses that have generated repeated bounce or complaint signals — may be flagged and the associated account may be restricted from receiving or triggering email communications through the platform. Members whose email addresses are flagged are encouraged to update their account with a current, valid email address and to contact [email protected] if they believe their address has been incorrectly identified.
HamClubOnline sends email communications on behalf of clubs and K6VEC through our email service providers. Members may opt out of almost all email communications from HamClubOnline. The only emails that cannot be disabled are password reset emails and password changed notification emails, both of which are account security notifications sent in response to specific account events and do not include an unsubscribe mechanism. HamClubOnline complies with the CAN-SPAM Act of 2003 in connection with commercial email sent through the platform, including honoring opt-out requests within 10 business days. Full details of our CAN-SPAM compliance practices are set out in our Privacy Policy.
Every email sent through HamClubOnline — with the exception of password reset and password changed notification emails — includes an unsubscribe or opt-out mechanism in the email footer. Members may also manage their email notification preferences directly through their HamClubOnline account profile. If you no longer wish to receive a particular category of email communication, you must use the opt-out method provided in the footer of those emails, log in to your account and update your notification preferences, or contact us at [email protected]. Do not report HamClubOnline emails as spam to your email provider as a substitute for using the opt-out mechanisms provided. Club administrators cannot reverse or override a member’s opt-out. Only the member themselves or HamClubOnline staff can reinstate an email subscription following an opt-out.
Reporting legitimate club communications as spam damages deliverability for all clubs and members who depend on the platform. Members who no longer wish to receive club emails are asked to use the unsubscribe links provided in the email footer or update their notification preferences in their account profile. Repeated or abusive spam complaints against verified opt-in communications may result in review or suspension of email dispatch to that address. If you have received an email in error or believe a communication was sent inappropriately, please contact [email protected] or your club administrator.
Section 7SMS and Voice Alerting
7.1Nature of the Service
HamClubOnline provides SMS and voice text-to-speech (TTS) alerting features to assist amateur radio clubs participating in communications programs such as ARES, RACES, and CERT, and to support authorized club drills, exercises, and activations requested by civil or governmental authorities. Activations may or may not involve an emergency situation. These features are supplemental communications tools only. HamClubOnline is not an emergency services provider, is not a public safety answering point (PSAP), and is not a substitute for calling 911 or other official emergency services in any situation involving an immediate threat to life or property.
7.2Best Effort Delivery — Not Guaranteed — Not for Life Safety
SMS and voice alert delivery through HamClubOnline is provided on a best-effort basis only. We do not guarantee the delivery, timeliness, completeness, or receipt of any SMS or voice alert message. Delivery may fail or be delayed due to factors entirely outside our control, including but not limited to: telecommunications carrier outages or congestion, SMS gateway failures, number portability issues, device unavailability, carrier message filtering, spam classification by receiving carriers, incorrect or outdated contact information in member records, or other technical failures in the delivery chain.
SMS and voice alerts transmitted through HamClubOnline must not be relied upon as the sole or primary means of notification in any situation involving the protection of life or property. Clubs and their authorized coordinators are solely responsible for maintaining independent, redundant communication methods for notifications. HamClubOnline expressly disclaims any liability for harm, loss, injury, or death arising from the failure of any SMS or voice alert to be delivered, received, or acted upon in a timely manner.
7.3Permitted Activations
SMS and voice alert activations are permitted for the following purposes only:
- Activations authorized by a designated club coordinator under an established ARES, RACES, CERT, or equivalent program, whether or not the activation involves an emergency
- Activations requested by civil or governmental authorities and relayed through an authorized club coordinator
- Authorized club drills, exercises, and tests of communications readiness, provided that all outgoing drill messages are clearly identified as drills in the message content (for example, beginning with “DRILL — THIS IS A DRILL” or equivalent unambiguous language)
- Notifications required for club communications planning that have been expressly authorized by the club coordinator
Activation for any other purpose — including testing the feature out of curiosity, harassment, or any unauthorized club communication — is a material violation of these Terms and will result in immediate suspension of alerting privileges and may result in termination of the club account.
7.4Activation Responsibility
Activations are solely at the discretion of authorized club coordinators designated by the club, or at the direction of civil or governmental authorities relayed through those coordinators. HamClubOnline has no role in determining when an activation is appropriate and bears no responsibility for any decision to activate or not activate an alert, for the content of any activated message, or for any action taken or not taken in response to an alert.
7.5A2P SMS — 10DLC Registration and Carrier Compliance
SMS messages sent through HamClubOnline are transmitted as Application-to-Person (A2P) messages over registered 10-digit long code (10DLC) telephone numbers. HamClubOnline maintains brand and campaign registration with The Campaign Registry (TCR) and complies with applicable A2P 10DLC requirements of participating United States wireless carriers. SMS delivery is subject to carrier filtering, throughput limits, and content policies imposed by individual carriers on registered 10DLC campaigns. HamClubOnline does not guarantee that messages will pass carrier filtering or be delivered within any particular timeframe.
7.6Member Opt-In, Opt-Out, and Consent
In accordance with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, HamClubOnline requires prior express written consent before delivering automated SMS messages or voice text-to-speech (TTS) calls to any member. Phone numbers and consent are managed at the club level — you must opt in separately for each club you wish to receive alerts from. Consent is obtained through an affirmative checkbox on the phone number entry page within your club profile for each club. The checkbox is unchecked by default and must be actively checked by the member to provide consent. Your consent, including the date, time, and IP address of your submission, is recorded and retained in accordance with TCPA requirements.
By checking the consent checkbox and providing your mobile or landline phone number within HamClubOnline, you expressly consent to receive automated SMS messages (mobile numbers only) and automated voice text-to-speech (TTS) calls (mobile and landline) from your club’s authorized coordinators through the HamClubOnline platform. These messages and calls may include activations, drills, exercises, and notifications requested by civil or governmental authorities, and may or may not involve an emergency situation. Consent to receive such messages and calls is a condition of participation in a club’s communications program through this platform.
You may withdraw consent at any time through any reasonable method that clearly expresses your desire to stop receiving SMS messages or voice calls. The following methods are all valid revocation paths:
- Replying STOP to any SMS message received through the platform, which will unsubscribe your number from all HamClubOnline A2P SMS messages
- Removing your phone number from your club profile for each club
- Contacting your club administrator to have your number removed from alerting
- Contacting HamClubOnline support at [email protected] by email or through the support system
Under FCC rules implementing the TCPA, consent revocation made through any reasonable means — including informal written or verbal requests to remove your number — must be honored within a reasonable time not to exceed 10 business days from receipt. You do not need to use the word “STOP” for your revocation to be valid; any clear expression of your intent to stop receiving messages is sufficient.
Reply HELP to any SMS message for assistance information. Message and data rates may apply. Message frequency varies based on club activation activity. For privacy information, visit hamclubonline.com/privacy/. To opt out of SMS, reply STOP.
Opting out via STOP or any other reasonable revocation method constitutes revocation of consent for all automated SMS messages and voice TTS calls from HamClubOnline, regardless of the category of message that prompted the opt-out. To comply with TCPA requirements, an opt-out applies across all clubs the member belongs to within HamClubOnline — not only the club whose activation prompted the opt-out. Voice TTS calls cannot be stopped by replying to an SMS — to stop voice calls, remove your phone number from your club profile, contact your club administrator, or contact HamClubOnline support at [email protected]. Members who opt out and wish to re-enroll must provide a new consent checkbox submission in their club profile for each club they wish to re-enroll with.
7.7Member Responsibility
Members who wish to receive SMS messages and voice TTS calls are responsible for ensuring their phone number and contact information in HamClubOnline is accurate and current. HamClubOnline bears no responsibility for failed delivery resulting from incorrect, outdated, or ported phone numbers in member records.
Section 8License Data and External Database Synchronization
HamClubOnline synchronizes amateur radio license data from the FCC Universal Licensing System (ULS) and, for Canadian licensees, from Innovation, Science and Economic Development Canada (ISED). This data is sourced from public government databases and is used to maintain current license information in member records.
We do not guarantee the accuracy, completeness, or timeliness of license data obtained from external government databases. License data displayed in HamClubOnline reflects our most recent synchronization with those databases and may not reflect real-time changes. Members and club administrators are responsible for verifying license information directly with the FCC or relevant licensing authority.
Section 9User Content and Submissions
The Service allows club administrators and members to upload files, enter notes, submit applications, and provide other content (“User Content”) in connection with club management activities.
By submitting User Content to the Service, you represent and warrant that:
- You have the right to submit the content and to grant us the limited rights described here
- The content does not infringe the intellectual property rights, privacy rights, or other rights of any third party
- The content does not violate any applicable law
You grant K6VEC Amateur Radio Group, Inc. a limited, non-exclusive, royalty-free license to store, display, and process your User Content solely as necessary to provide the Service to you and your club. We do not claim ownership of your User Content. We will not use User Content for any purpose beyond operating and improving the Service.
9.1File Storage
Files uploaded by club administrators and members through HamClubOnline are stored in Linode Object Storage, a cloud-based object storage service operated by Linode (an Akamai company) at their data center in Fremont, California. By uploading files to HamClubOnline, you consent to those files being stored in Linode Object Storage. Club administrators are responsible for ensuring that files uploaded to the platform comply with applicable laws and do not contain content that violates these Terms.
9.2Backups
HamClubOnline performs regular backups of platform data, including member records, club data, and uploaded files. Backups are maintained on Linode infrastructure and encrypted offline backup copies are transmitted to Backblaze B2 cloud storage for additional redundancy and disaster recovery purposes. Backup data is encrypted prior to transmission and storage, and is retained solely for platform recovery and is not used for any other purpose.
While we maintain backups as described above, we do not guarantee that any specific version of your data can be recovered in all circumstances. Backups are a platform-level operational measure and do not substitute for club administrators maintaining their own independent exports of club data using the on-demand export tools described in Section 12.
We reserve the right to remove any User Content that violates these Terms or that we determine in our sole discretion to be harmful, offensive, or otherwise inappropriate, without prior notice.
Section 10Intellectual Property
The HamClubOnline platform, including its software, design, features, text, graphics, and all other content created by K6VEC Amateur Radio Group, Inc., is owned by K6VEC Amateur Radio Group, Inc. and is protected by United States and international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose of amateur radio club management. This license does not include the right to reproduce, modify, distribute, create derivative works from, publicly display, or commercially exploit any portion of the Service or its content without our express written permission.
The name “HamClubOnline” and associated logos are the property of K6VEC Amateur Radio Group, Inc. Nothing in these Terms grants you any right to use our name, logos, or trademarks without our prior written consent.
10.1Prohibition on Reverse Engineering
You may not, and you may not permit or assist any third party to, directly or indirectly:
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive or reconstruct the source code, underlying algorithms, data structures, architecture, or security mechanisms of the HamClubOnline platform or any component thereof
- Attempt to discover, extract, or map the internal logic, database schema, or security implementation of the platform through any means, including but not limited to probing via the API, monitoring network traffic, fuzzing, or systematic trial-and-error testing of platform behavior
- Use any tool, technique, or process to circumvent, bypass, or defeat any technical protection measure, access control, authentication mechanism, or security feature implemented in the Service
- Create or attempt to create any software, service, or product that is substantially derived from or functionally replicates the HamClubOnline platform without our express prior written permission
- Analyze or benchmark the Service for the purpose of developing a competing product or service
These prohibitions apply regardless of the purpose for which reverse engineering is undertaken and regardless of whether the information obtained through reverse engineering is publicly available elsewhere. A violation of this subsection constitutes a material breach of these Terms and will result in immediate termination of access to the Service. K6VEC Amateur Radio Group, Inc. reserves all rights and remedies available under applicable law, including the Digital Millennium Copyright Act (DMCA) and applicable trade secret law, in connection with any violation of this subsection. Nothing in this subsection prohibits security research conducted in good faith in accordance with our Security Vulnerability Disclosure Policy.
10.2Third-Party Content and Ownership
Files, photographs, documents, images, and other content uploaded to HamClubOnline by members or club administrators remain the property of their respective owners. HamClubOnline claims no ownership over such content beyond the limited license described in Section 9. The presence of content on the platform does not imply any transfer of ownership or grant of rights beyond those expressly stated in these Terms.
Members and club administrators are solely responsible for ensuring that any content they upload, store, or distribute through HamClubOnline does not infringe the intellectual property rights, privacy rights, or other rights of any third party. This includes ensuring appropriate rights or permissions exist for any photographs, images, logos, documents, or other materials uploaded to the platform that were created by or belong to a third party. HamClubOnline is not responsible for content uploaded by members or club administrators and will not be liable for any infringement arising from such content.
10.3DMCA Copyright Infringement Notice
HamClubOnline respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. If you believe that content stored on HamClubOnline infringes your copyright, you may submit a written notice to our designated DMCA agent containing the following information:
- A description of the copyrighted work you claim has been infringed
- A description of the material you claim is infringing and its location on the platform
- Your contact information, including name, address, telephone number, and email address
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf
- Your physical or electronic signature

Upon receiving a valid DMCA notice, we will act expeditiously to remove or disable access to the allegedly infringing content and will notify the member or club administrator who uploaded the content. Repeat infringers may have their accounts terminated. If you believe your content was removed in error, you may submit a counter-notification in accordance with the DMCA.
Section 11Third-Party Services and Links
The Service integrates with or provides links to third-party services including PayPal, Square, Groups.io, the FCC ULS, and others. These third-party services are governed by their own terms of service and privacy policies. We do not endorse, control, or assume responsibility for the content, policies, or practices of any third-party service.
Your use of any third-party service is at your own risk and is subject to that service’s terms. We have no liability for any harm or damages arising from your use of third-party services accessed through or in connection with HamClubOnline.
Section 12Service Availability, Security Safeguards, and API Access
12.1Optional Feature — Frequency Coordination
Clubs serving as frequency coordinating bodies may request activation of the optional frequency coordination feature. This feature is provided at no charge and is available at the sole discretion of HamClubOnline. When activated, it allows the coordinating body to maintain repeater frequency coordination records within their coordination area, including repeater frequency, offset, CTCSS/DCS tone, location, sponsoring club, and trustee information.
Repeater contact information stored in coordination records is linked to the trustee’s HamClubOnline member record. Full coordination records are accessible only to authorized coordinators within the coordinating body. A subset of coordination data — including repeater callsign, frequency, and offset, and where the coordinating body has elected to share them, location and tone — may be made visible to club members and the general public.
Club administrators using the frequency coordination feature are solely responsible for:
- Obtaining all necessary approvals from the relevant frequency coordinating body or bodies before storing and managing coordination records within HamClubOnline
- Ensuring that their use of the platform for frequency coordination purposes is authorized by and complies with the policies, bylaws, and requirements of the coordinating organization
- The accuracy, completeness, and currency of all coordination records entered into the platform
- The content of coordination records, including any data shared publicly or with club members
HamClubOnline does not review, approve, validate, or verify the accuracy of repeater coordination records entered by club administrators. HamClubOnline bears no responsibility for inaccurate, incomplete, or unauthorized coordination records, or for any consequences arising from the use of such records. Clubs using the frequency coordination feature indemnify K6VEC Amateur Radio Group, Inc. for any claims arising from unauthorized use of coordination records or inaccurate data published through the platform, in accordance with Section 17 of these Terms.
Clubs using the frequency coordination feature may export their coordination data at any time. Active coordination records are retained indefinitely. Coordination records for retired repeaters are retained for 36 months from the date of retirement and are then deleted. To request activation of the frequency coordination feature, contact [email protected].
12.2Service Availability
We provide HamClubOnline on an “as available” basis. We do not guarantee uninterrupted or error-free operation of the Service. We reserve the right to:
- Perform scheduled and emergency maintenance, during which the Service may be temporarily unavailable
- Modify, add, or remove features of the Service at any time
- Suspend or discontinue the Service, or any portion thereof, with reasonable notice to active users where practicable
We maintain a public uptime status page hosted by UptimeRobot, a third-party monitoring service, at https://stats.uptimerobot.com/WnVVrt1N. That page is operated by UptimeRobot and is subject to UptimeRobot’s own terms of service. We make reasonable efforts to communicate planned maintenance in advance and to minimize disruption to clubs and their members.
12.3Service Discontinuation
In the event that K6VEC Amateur Radio Group, Inc. decides to permanently discontinue the HamClubOnline Service, we will make every attempt to provide reasonable advance notice to club administrators prior to termination. We will endeavor to allow sufficient time for clubs to retrieve and preserve their membership data before the Service is terminated, though we cannot guarantee a specific notice period in all circumstances.
We strongly encourage all club administrators to maintain regular independent backups of their club’s data and not to rely solely on HamClubOnline as the permanent custodian of club records. HamClubOnline provides the following tools for this purpose:
- On-demand data exports: Club administrators may export their club’s membership roster, financial records, skills data, and other club information at any time using the export functions available in the club administration menu. We recommend that club administrators perform exports on a regular schedule and retain copies in a secure location independent of HamClubOnline.
- Read-only API: Clubs may use the HamClubOnline read-only API to programmatically retrieve and archive club data on an ongoing basis. API use is subject to the conditions described in the Club API Access subsection below.
K6VEC Amateur Radio Group, Inc. bears no liability for loss of club data that could have been preserved through the use of these tools prior to service discontinuation. The availability of these export and API tools does not constitute a guarantee that they will remain available for any specific period following a discontinuation notice.
12.4Automated Security Safeguards
HamClubOnline employs automated security systems designed to protect the platform and its users from unauthorized access, abusive traffic, denial-of-service attempts, and other threats. These systems operate continuously and may, in some circumstances, incorrectly identify legitimate user activity as a potential threat. When this occurs, access to the Service — or to specific features of the Service — may be temporarily blocked, rate-limited, or otherwise restricted without prior notice, even for users who are acting in good faith.
We do not guarantee that automated security measures will not result in erroneous interruptions of service for legitimate users. If you believe your access has been incorrectly blocked or restricted by an automated security system, please contact us at [email protected] and we will investigate. K6VEC Amateur Radio Group, Inc. bears no liability for service interruptions caused by automated security safeguards operating as designed, or for any erroneous restrictions that occur as a result of those safeguards. If you believe you have identified a security vulnerability in the platform, please refer to our Security Vulnerability Disclosure Policy before conducting further testing.
12.5Club API Access
HamClubOnline makes a read-only application programming interface (API) available to clubs to allow authorized integration of club data with external systems and websites. API access is available without prior approval from HamClubOnline and may be modified or revoked at any time without prior notice.
Access to a specific club’s data through the API must be granted by a club administrator for that club. API access is not enabled for a club by default and requires explicit authorization by the club administrator through the club administration interface. Club administrators are responsible for managing who has been granted API access to their club’s data and for revoking access when it is no longer required.
Three read-only endpoints are available: a Members endpoint returning club roster data, an Events endpoint returning club calendar events, and an Assets endpoint returning club asset records. All endpoints require authenticated credentials and are limited to data belonging to the club that granted access.
API access is provided on a best-effort basis only and is subject to the following conditions:
- Read-only: The API provides read-only access to authorized club data. No write, update, or delete operations are supported through the API.
- Rate limiting: API requests are subject to rate limiting. Requests that exceed applicable rate limits will be rejected. Rate limits may be adjusted at any time without prior notice.
- No uptime guarantee: We do not guarantee the availability, continuity, or response time of the API. The API may be unavailable during maintenance windows, as a result of security safeguards, or due to other factors. External systems or websites that depend on the API should be designed to handle API unavailability gracefully.
- Data accuracy: API responses reflect data as stored in HamClubOnline at the time of the request and are subject to the same data accuracy limitations described in these Terms. We do not warrant the accuracy or completeness of data returned through the API.
- Permitted use: The API may be used only for the authorized club’s own legitimate club management and public information purposes. Use of the API to harvest data, build competing services, or access data belonging to any club other than the authorized club is strictly prohibited and will result in immediate revocation of API access and may result in termination of the club account.
- No liability: K6VEC Amateur Radio Group, Inc. bears no liability for any harm, loss, or disruption resulting from API unavailability, rate limiting, inaccurate data returned through the API, or revocation of API access.
Section 13Donations and Payments
13.1Voluntary Donations to K6VEC
HamClubOnline is provided free of charge and relies on voluntary donations from club administrators to help cover operating costs. Most clubs contribute approximately $1 per active member per year. Donations are entirely voluntary and have no effect on a club’s access to or use of the Service. Clubs that donate will be recognized as HamClubOnline Supporting Clubs. Contributions to K6VEC may be tax-deductible; consult your tax advisor. To make a donation, use the donate link on the hamclubonline.com homepage or contact [email protected]. Financial information about K6VEC may be obtained by contacting us at [email protected] or from the California Attorney General’s Registry of Charities at oag.ca.gov/charities.
HamClubOnline may reference club names, general location (city, state, and country), website where provided, and aggregate member counts in promotional and marketing materials. This use is limited to club-level information only and does not include any individual member personal information. Clubs may opt out of this use at any time by contacting [email protected].
13.2Club Dues Processed Through the Platform
Not all clubs collect membership dues through HamClubOnline. Use of the platform’s payment processing features is entirely at the discretion of each club administrator. Clubs may also collect dues outside of HamClubOnline — for example by check, cash, or through their own payment systems — in which case K6VEC and HamClubOnline are not involved in or responsible for those transactions.
For clubs that do configure HamClubOnline to collect membership dues through PayPal or Square: any such dues are determined by the individual club, not by K6VEC or HamClubOnline. K6VEC is not a party to the dues transaction between a club and its members. Questions or disputes about club dues amounts, refunds, or policies should be directed to the relevant club administrator.
13.3Charitable Fundraising Platform Disclaimer
HamClubOnline is not a charitable fundraising platform as defined under California Government Code § 12599.9 (Assembly Bill 488). While AB 488 is a California statute applicable to California-based operations and transactions, K6VEC Amateur Radio Group, Inc. is a California nonprofit corporation and this disclaimer reflects the character of the platform as it operates under California law. The payment processing features of HamClubOnline are provided solely to facilitate the collection of membership dues from club members where a club has elected to charge dues. Not all clubs charge membership dues. Where dues are collected, they are paid by club members and are not solicited from or intended to be received from the general public as charitable donations. HamClubOnline does not permit clubs to use the platform to solicit charitable contributions from the public, and does not operate as an intermediary for public-facing charitable fundraising on behalf of any club or organization, regardless of where that club is located. Clubs are additionally prohibited from using the platform to solicit membership from the general public — HamClubOnline is intended solely for the management of existing club membership, designated non-member affiliates as described in Section 5, and communications with those individuals. The inclusion of non-member affiliates as designated recipients of club communications does not alter the non-fundraising character of the platform.
13.4Refunds

Section 14Termination
This section covers how individual member accounts and club accounts may be terminated or removed from HamClubOnline, whether initiated by the member or club, by HamClubOnline, or as a result of inactivity. The data handling consequences of any club removal or inactivation are described in the Effect of Club Removal or Inactivation subsection below and apply regardless of the reason for removal.
14.1Individual Account Termination by You
An individual member may terminate their personal HamClubOnline account at any time by notifying us at [email protected]. Upon termination, your access to the Service will be discontinued. Certain information may be retained by club administrators independently of your account status, as described in our Privacy Policy. This provision applies to individual member accounts only. A club wishing to remove itself from the platform should follow the Voluntary Club Removal process described below.
If you are a club administrator and you terminate your individual account, your club may be left without an active administrator. In that event, the club will need to follow the administrator recovery process described in Section 5 to restore appropriate administrative access. If no other club administrator exists and no recovery can be completed, the club account may become inactive and subject to the Inactive Club Removal provisions of this Section.
14.2Voluntary Club Removal
A club administrator may request removal of their club from the HamClubOnline platform at any time by contacting [email protected]. Before processing a removal request, HamClubOnline will verify the request with the club administrator of record to confirm authorization. Club administrators are encouraged to export all club data using the on-demand export tools described in Section 12 before submitting a removal request. Upon processing a verified removal request, the club account will be inactivated and the data handling described in the Effect of Club Removal or Inactivation subsection below will apply.
14.3Termination by Us
We reserve the right to suspend or terminate any individual account or club’s access to the Service at any time and for any reason, including but not limited to:
- Violation of any provision of these Terms
- Conduct that we determine, in our sole judgment, is harmful to other users, the platform, or the amateur radio community
- Club account inactivity as described below
- Any use of the Service that creates legal liability for K6VEC Amateur Radio Group, Inc.
- Any conduct that results in or creates a risk of financial harm to K6VEC Amateur Radio Group, Inc., including but not limited to fines, penalties, carrier fees, or costs arising from a club’s or user’s use of the Service
Where practicable, we will provide notice of termination and an opportunity to export club data prior to account closure. In cases involving violations of law, abuse of the alerting system, security threats, or financial harm to K6VEC, we reserve the right to terminate access immediately and without prior notice.
14.4Individual Account Suspension or Termination for Abuse
HamClubOnline reserves the right, at its sole discretion, to suspend or permanently terminate any individual member account if that member engages in abusive, harmful, or prohibited conduct through the platform. Such action may be taken regardless of whether the member is also a club administrator, and regardless of the effect on any club the member administers.
Conduct that may result in individual account suspension or termination includes, without limitation:
- Attempting to gain unauthorized access to another member’s account, another club’s data, or any portion of the platform’s infrastructure
- Violation of the reverse engineering, automated access, or AI training prohibitions in Sections 10 and 6
- Harassment, impersonation, or fraudulent conduct directed at other members, club administrators, or HamClubOnline staff
- Misuse of any platform communication feature in violation of Section 6 or Section 7
- Uploading, transmitting, or distributing unlawful content through the platform
- Any other conduct that HamClubOnline determines, in its sole judgment, to be harmful to other users, the platform, or the broader amateur radio community
Individual account suspension or termination may be immediate and without prior notice where the conduct involves a security threat, violation of law, or serious harm to the platform or its users. Where a terminated member was a club administrator, the club will need to follow the administrator recovery process described in Section 5. HamClubOnline may refer serious violations to law enforcement authorities or relevant regulatory bodies where appropriate.
14.5Inactive Club Removal
A club account that has had no recorded activity for a continuous period of 24 months may be removed from the Service. Activity includes, without limitation, any login by a club administrator, any member record update, any communication sent through the platform, any payment processed, or any other interaction with the club’s account through the HamClubOnline application.
Before removing an inactive club account, we will make reasonable efforts to notify the club administrator at the email address on file. Club administrators are responsible for ensuring their contact information is current. If no response is received within 30 days of the inactivity notice, the club account may be removed without further notice. Club administrators of inactive accounts are encouraged to export their club’s data using the on-demand export tools described in Section 12 before the account is removed. Once a club account is removed for inactivity, recovery of club data cannot be guaranteed. If a previously inactive club wishes to return to the Service after removal, a new club account must be established.
14.6Club-Level Suspension or Termination for Abuse
HamClubOnline reserves the right, at its sole discretion, to suspend or permanently terminate service to an entire club if that club or any of its members engages in abusive, harmful, or prohibited conduct through the platform. Abuse by one or more members of a club may result in suspension or termination of service to the club as a whole, regardless of whether the club administrator was directly involved in or aware of the abusive conduct.
Actions that may result in club-level suspension or termination include, without limitation, repeated or egregious violations of the Acceptable Use provisions in Section 6, misuse of the SMS and voice alerting system, systematic harvesting or misuse of member personal data, conduct that places a disproportionate burden on platform infrastructure, or any pattern of behavior that HamClubOnline determines, in its sole judgment, to be harmful to the platform, its users, or the broader amateur radio community.
We will make reasonable efforts to notify club administrators prior to club-level suspension where doing so does not compromise the security of the platform or its users. Club administrators are responsible for ensuring that their club’s members are aware of and comply with these Terms, and are encouraged to address member conduct issues promptly to avoid club-level consequences.
14.7Effect of Club Removal or Inactivation
The following data handling applies to all club account removals or inactivations, whether resulting from a voluntary removal request, inactivity removal, or termination for cause.
Upon inactivation, the club and its members will no longer have access to the club’s data or features through HamClubOnline. Data associated with the inactivated club will be subject to the standard data retention periods described in our Privacy Policy, with the following modification: data categories that would otherwise be retained indefinitely — including club membership records, financial records, election records, and asset records — will be deleted 24 months after the date of inactivation. Where deletion of a record would cause data integrity issues — such as account balances or interdependent records becoming inaccurate or inconsistent — personal identifying information will be removed from the affected records while non-identifying data necessary to maintain integrity is retained.
Time-limited data categories — including security and activity logs, email delivery logs, SMS and voice alert delivery logs, and event attendance records — will continue to be deleted according to their standard retention schedules from the date each record was created and will not be extended by the inactivation date. Email opt-out events and SMS and voice opt-out events will be retained in accordance with CAN-SPAM and TCPA requirements.
Individual member accounts that exist independently of the club are not deleted as part of a club removal or inactivation. Members who activated their own HamClubOnline accounts retain access to their personal account. Members who were added to the platform solely through the removed club and who have not activated an independent account will lose access to the platform upon club inactivation.
14.8Effect of Termination
All provisions of these Terms that by their nature should survive termination — including intellectual property rights, disclaimer of warranties, limitations of liability, indemnification, and governing law — shall survive termination of your account or of the Service.
Section 15Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, K6VEC AMATEUR RADIO GROUP, INC. EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF LICENSE DATA SYNCHRONIZED FROM THE FCC ULS OR OTHER EXTERNAL DATABASES, OR THE ACCURACY OF ANY OTHER INFORMATION DISPLAYED THROUGH THE SERVICE.
Some jurisdictions do not allow the exclusion of certain warranties. To the extent such exclusions are not permitted under applicable law, including California law, those exclusions shall apply only to the fullest extent permitted.
Section 16Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL K6VEC AMATEUR RADIO GROUP, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, LOSS OF GOODWILL, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT OF DONATIONS OR PAYMENTS YOU HAVE MADE TO K6VEC IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS (USD $100.00).
Exceptions and California Law. Notwithstanding the above, nothing in these Terms limits or excludes our liability for:
- Our own fraud or fraudulent misrepresentation
- Gross negligence or willful misconduct on our part
- Death or personal injury caused by our negligence
- Any liability that cannot be excluded or limited under California law, including but not limited to liability under the California Consumers Legal Remedies Act (Cal. Civ. Code § 1750 et seq.)
- Any liability that cannot be excluded or limited under any other applicable law
These limitations reflect a reasonable allocation of risk between you and K6VEC as a free nonprofit service. Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, our liability is limited to the greatest extent permitted by law.
Section 17Indemnification
You agree to defend, indemnify, and hold harmless K6VEC Amateur Radio Group, Inc., its officers, directors, employees, volunteers, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of or access to the Service
- Your violation of any provision of these Terms
- Your violation of any applicable law or the rights of any third party
- Any User Content you submit to the Service
- Your exercise of club administrator privileges, including any misuse of member personal information
- Your club’s use of any HamClubOnline communication feature — including email, SMS, voice alerting, or newsletters — in a manner that violates applicable law, including but not limited to the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, applicable state anti-spam or privacy laws, or any foreign equivalent
- Any regulatory investigation, enforcement action, fine, penalty, or claim by a governmental authority or third party arising from your club’s use of the Service, regardless of whether HamClubOnline was aware of or involved in the conduct giving rise to such action
This indemnification obligation applies to all users of the Service, including club administrators acting on behalf of their club and individual members. K6VEC Amateur Radio Group, Inc. provides HamClubOnline as a platform through which clubs independently manage their own communications and operations. Each club is solely responsible for ensuring its use of the platform complies with all applicable laws in the jurisdictions in which it operates and in which its members reside. HamClubOnline does not review or approve outgoing club communications and bears no responsibility for the content, targeting, or legal compliance of communications sent by clubs through the platform.
We reserve the right to assume exclusive control of the defense of any matter for which you are required to indemnify us, in which case you agree to cooperate with our defense of such claims at your own expense.
17.1Right to Seek Direct Financial Remedy
In addition to the indemnification obligations set out above, K6VEC Amateur Radio Group, Inc. expressly reserves the right to seek direct financial remedy from any club or user whose conduct causes harm to HamClubOnline, K6VEC, or the platform’s ability to operate. This right applies independently of and in addition to any indemnification obligation and does not require a third-party claim to have been made against K6VEC.
Harm giving rise to K6VEC’s right to seek direct financial remedy includes, without limitation:
- Fines, penalties, or fees levied against K6VEC or HamClubOnline by any governmental authority, carrier, or industry body as a result of a club’s or user’s conduct on the platform
- Suspension, restriction, or termination of HamClubOnline’s accounts with third-party service providers — including SMS gateways, email delivery providers, payment processors, or cloud infrastructure providers — caused by a club’s or user’s misuse of the platform
- Costs incurred by K6VEC to remediate, restore, or replace platform capabilities lost as a result of a club’s or user’s conduct
- Legal fees, settlement costs, or judgment amounts arising from claims brought against K6VEC by third parties as a direct result of a club’s or user’s use of the Service
- Reputational or operational harm to the platform caused by a club’s or user’s conduct that results in measurable financial loss to K6VEC
- Any other direct financial loss suffered by K6VEC as a proximate result of a club’s or user’s violation of these Terms or applicable law
K6VEC may pursue such financial remedy through any available legal means, including direct demand, mediation, arbitration, or litigation in the courts of Orange County, California, as provided in Section 19 of these Terms. The right to seek financial remedy does not require K6VEC to first terminate the club’s access to the Service, and termination of access does not limit or waive K6VEC’s right to pursue financial recovery for harm already caused.
Section 18Accuracy of Information
We make reasonable efforts to ensure that information published on hamclubonline.com is accurate and current. However, we do not warrant that all information on the site is accurate, complete, or current at all times. Content on the site is provided for general informational purposes and should not be relied upon as the sole basis for any decision.
We reserve the right to correct errors, update information, and modify the content of the site at any time without notice. This includes information about platform features, which may change as the Service is updated.
Section 19Governing Law, Venue, and Dispute Resolution
These Terms of Service and any dispute arising out of or related to your use of the Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
Any legal action or proceeding arising out of or related to these Terms or the Service shall be brought exclusively in the state or federal courts located in Orange County, California. You consent to the personal jurisdiction of those courts and waive any objection to venue in Orange County, California.
Before initiating any formal legal proceeding, you agree to contact us at [email protected] and provide a written description of the dispute. We will make a good-faith effort to resolve the issue informally within thirty (30) days of receiving your notice. This informal dispute resolution requirement does not apply to claims involving intellectual property infringement or emergency injunctive relief.
Section 20General Provisions
20.1Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable under applicable law, that provision shall be deemed severed from these Terms and shall not affect the validity and enforceability of the remaining provisions, which shall continue in full force and effect.
20.2Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of a provision of these Terms must be in writing and signed by an authorized representative of K6VEC Amateur Radio Group, Inc. to be effective.
20.3Entire Agreement
These Terms of Service, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and K6VEC Amateur Radio Group, Inc. regarding the Service and supersede all prior and contemporaneous agreements, representations, and understandings, whether oral or written.
20.4Assignment
You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms in connection with a transfer of assets to a successor nonprofit organization, provided the successor organization assumes these Terms in full.
